0303 Notices for the Application of National Living Abroad without Registered Household in Taiwan Area for Residence in Taiwan Area

Governing laws:
Article 9 and 16 of Immigration Act (hereinafter the Immigration Act)。
Article 14 to 16 of Regulations Governing the application for residency in Taiwan Area of national without registered permanent residence in the Taiwan Area (hereinafter the national without registered permanent residence).Subjects:
A national residing abroad without registered permanent residence in the Taiwan Area may apply for residence in the Taiwan Area if he/she falls within any of the following circumstances:
Has a lineal blood relative, a spouse, a sibling, or a spouse's parent, who has registered permanent residence in the Taiwan Area. If the relationship is a result of adoption, the adopted person shall not be older than twelve (12) years old; he/she shall reside with the adopter in the Taiwan Area. The adoption is limited to two (2) people.
Serves as an overseas legislator.
Was or is born in overseas, resides in the Taiwan Area and has registered his/her permanent residence at a household registry in the area. The person is at the age of twenty (20) or up.
Holds the passport of the State to enter into the State, and continues to reside in the Taiwan Area for seven (7) years or up, and one hundred and eighty-three (183) days or up each year.
Has made an investment in the Taiwan Area in the amount that is more than NT$10,000,000, and has been approved or filed for future reference by the central authorities in charge of the investment.
Is an overseas student who has been approved to study in the State by a central authority in charge of the field concerned and has returned to his/her country of residence to work for two (2) years after graduation.
Has special contributions to the country and the society, or is a senior professional personnel as needed in the Taiwan Area.
Has special skills and experiences and has been invited back to the State by the central authorities that are in charge of the field of their employment.
Has been appointed or employed by a government department, a public or private university or a college besides the authorities stated in the preceding Subparagraph.
Has been approved to work in the Taiwan Area by the central authorities in charge of labor affairs or the field of their employment pursuant to Subparagraphs 1 to 7 or Subparagraph 11, Paragraph 1 of Article 46 of the Employment & Service Act..
Is an overseas student who has been approved to study in the State by a central authority in charge of the field concerned.
Is a trainee who has been approved to take vocational training by a central authority in charge of the field concerned.
A master graduate student or a doctorate student who has been approved to undertake research and serve as an intern by a central authority in charge of the field concerned.
Has been approved to work in the Taiwan Area by the central authority in charge of labor affairs in accordance with Subparagraph 8 to 10, Paragraph 1 of Article 46 of the Employment & Service Act.
The spouses and minor children of the national stated in Subparagraph 1 to 10 of the preceding Paragraph may apply with the national; the spouses and minor children who have not applied with the national may apply after the approval of the national’s application for residence in the Taiwan Area and before the approval of the application for registered permanent residence in the State.
Nationals without registered permanent residence who have entered the country before the Immigration Act was enforced and cannot be repatriatedApplication procedures and places:
Overseas: apply to our overseas embassies, representative offices, overseas office or other institutions authorized by Ministry of Foreign Affairs (hereinafter the Overseas Office) and the Overseas Office will forward the application to National Immigration Agency (hereinafter the NIA) for management.
Mainland China: apply to the institutions as set forth in paragraph 1, article 4 of Act Governing Relations between the People of the Taiwan Area and the Mainland Area or branches of designated private organizations as set forth in paragraph 2 of the same Act, and the application will be forwarded to NIA for management. If there is no branch, the relative, spouse in Taiwan Area or their designated immigration institution, travel agents in A class or above shall apply to NIA on behalf.
Hong Kong or Macau: apply to Taipei Economic and Cultural Office in Hong Kong or Macau, , and the application will be forwarded to NIA for management.
Taiwan Area: apply to the service centers of NIA by the applicant or other designated person or immigration institutionRequired documents:
Application, with one color photo without hat (the same specification of photo for ID card)
Identity certificate in country or place of residence or (refer to the passport in country of residence; however, it is permanent resident permit or long-term residence certificate if the citizenship has not yet acquired)
The passport of the Republic of China or certificate as sufficient to prove the nationality of the Republic of China, e.g. nationality certificate, certificate of overseas Chinese (excluding the certificate of Chinese ethnicity issued by Overseas Chinese Affairs Council) or military certificate previously issued by Department of National Defense
Certificate national police criminal record in country or place of residence, which is valid for six months from the date of issuance (e.g.: those who reside in America shall present the nationwide criminal record issued by US Federal Bureau of Investigation); it is exempted for people under the age of 20. However, the certificate shall be enclosed upon the approval of distribution when there is quota limit.
The satisfactory health examination report within latest three months (the examination must be managed by public or private hospitals appointed by Ministry of Health and Welfare as well as satisfactory to the health examination checklist [table B]; the report is exempted for children between the age of six and twelve who only need to be examined for measles and German measles and related vaccination certificates are enclosed). Children under the age of six may use vaccination certificate as alternative. However, the certificate shall be enclosed upon the approval of distribution when there is quota limit.
The person who was born in China shall have certificates proving that he/she does not have no household registered in China or collect passport of China certified by Straits Exchange Foundation enclosed otherwise.
POA: the POA shall be enclosed for application managed by agent and the agent shall sign or affix seal on the signature/seal of agent in person
If the applicant is a minor child, the consent of parents shall be enclosed; if the parents are divorced, the consent of party exercising or assuming the rights and obligations of children shall be acquired.
Those who has entered the country and applied for residence (shall enter the country with passport of the Republic of China), the entry certificate shall be enclosed.
For application abroad, the certificate fee is NT$1,300; for application within legal residence period after entering the county, the certificate is NT$1,000 and the certificate fee is NT$500 for overseas Chinese students.

If the information regarding the application for residence in Taiwan Area is unsatisfactory or insufficient, it shall be corrected within fifteen days from the next day of receiving written notice of NIA (the correction period shall be three months if the application information shall be applied to foreign country or the application is managed abroad). For failure to make correction by deadline, the NIA will reject its application.
If the documents required is in foreign language, they shall be certified by Overseas Office and have the transaction in Chinese certified by Overseas Office or domestic public notary enclosed.
For application of residence filed abroad, the single entry permit and carbon copy of Residence Certificate of Taiwan Area will be issued. The applicant shall enter the county against the certificate before the expiration of such carbon copy (valid for six months from the next day of issuance) and switch such carbon copy, Alien Resident Certificate (exempted if not applicable) and identity certificate to Residence Certificate of Taiwan Area at service centers of the NIA within fifteen days after the next date of entry. However, when the applicant has not reached age of fourteen, the switch may be managed by his/her legal representative or via registered mail.
Period as required for review: seven days (excluding the date received, holidays, document supplementation and mailing period)
