Guidelines for Nationals without Household Registration in the Taiwan Area Applying for Residence in the Taiwan Area Due to Overstaying, in accordance with Paragraph 5 of Article 9 of the Immigration Act

(I) Subparagraph 5 of Paragraph 1 of Article 9 of the Immigration Act.
(II) The National Immigration Agency (NIA) issued Letter No. 0980124842 on September 1, 2009.
II. Applicable Subjects: Nationals without household registration in the Republic of China (ROC) (hereinafter referred to as "nationals without household registration") holding ROC passports, who have legally stayed continuously in the Taiwan Area for more than five (5) years, with a residence of at least 183 days per year, and those who have overstayed in the Taiwan Area.
III. Application Procedure: Applicants are required to apply in person at the service stations located in the municipalities, counties (cities), which are under the jurisdiction of the administrative corps of the National Immigration Agency (NIA).
IV. Required Documents:
(I) Application form with a color, uncovered head photo (following the same specifications as a national ID photo).
(II) Proof of residence or domicile.
(III) ROC passport.
(IV) Certificate of criminal record from the police in the place of residence or domicile.
(V) Health examination certificate issued within the last three (3) months (to be conducted by public or private hospitals designated by the Ministry of Health and Welfare, and in compliance with the health examination checklist for residence or registered permanent residence as determined by them).
V. Document Fee: NTD 1,000.
VI. Notes:
(I) In cases where the information provided for residency in the Taiwan Area is incomplete or inaccurate, applicants shall have fifteen (15) days from the day following the receipt of written notification from the NIA to rectify the issue. For overseas applications or cases, the rectification period is three (3) months. Failure to rectify within the stipulated period may result in the rejection of the application by the NIA.
(II) Documents submitted, if produced overseas, must be authenticated by the respective overseas diplomatic mission, consulate, office, or other authorized agencies of the Ministry of Foreign Affairs (hereinafter referred to as "overseas missions"). If produced domestically by overseas missions or authorized institution, they must be authenticated by the Ministry of Foreign Affairs. If produced in Hong Kong, Macau, or Mainland China, they must be authenticated by the Service Division of the Taipei Economic and Cultural Office in Hong Kong or Macau, or the Straits Exchange Foundation.
(III) Nationals without household registration who are currently overstaying in the Taiwan Area:
1. Having legally resided in the Taiwan Area for five (5) consecutive years, with a residence of at least 183 days per year, and having no criminal record, one may apply for residency in the Taiwan Area after paying the fine.
2. Having legally resided in the Taiwan Area for five (5) consecutive years, with a residence of at least 183 days per year, if one has a criminal record, upon paying the fine and leaving the ROC, they shall not be restricted from re-entering the ROC. If their criminal record is over five (5) years and they have not committed any further crimes within five (5) years, they may apply for residency in the Taiwan Area.
3. Having not legally resided in the Taiwan Area for five (5) consecutive years, upon paying the fine and leaving the ROC, shall not be restricted from re-entering the ROC. However, those who have legally resided in the Taiwan Area for five (5) consecutive years, with a residence of at least 183 days per year, may apply for residency in the Taiwan Area.
